This article is an attempt to understand “Bounds of Ethics in a Globalized World”, the hiatus between principles, norms and values and how they are codified on the one hand and the risks that follow when the actualisations of regulative principles fail in political reality on the other hand. Considering the political, economic and social reality, it is frequently diagnosed that reality is lagging far behind the potential of constitutionally guaranteed rights and duties. A variety of constitutionally guaranteed values suffers (...) from devaluation. Taking examples from Bavaria in Germany, questions concerning whether the Bavarian society is at the borders of ethical capacities, or whether the limits of possible ethical regulation have been reached are dealt with. Important parallels in the genesis of the Bavarian and the Indian constitution are highlighted in this context. Through an understanding of the ideas of Ludwig Erhard, a pragmatic approach and an innovative model is proposed for cultivating values in a sustainable way. The importance of values of virtues is discussed and an emphasis is put on the importance of practiced virtues. (shrink)

Narrative has proven itself a continuous as well as adaptable means for environmentally oriented expression. Its role goes beyond the mediation of pre-existing knowledge imported into the realm of storytelling from other domains; rather, influential models of the natural world tend to circulate as storyworlds. This special issue of SubStance proceeds from the premise that narratives are not only a sequence of signs encoding a story but also “invisible, elusive representations that exist only in the mind”. Until now, the short cult hymns to Liber, Mars and Juno in the Appendix Claudianea have mostly been seen as rhetorical school exercises. Yet a philological-historical analysis shows that they could be remains of occasional poetry from everyday life. The hymns are structured according to the Roman festival calendar and, on the basis of language and content, should probably be dated to the final phase of public non-Christian cult practice in the fourth century. The anonymous poet was familiar with (...) classical Greek and Latin poetry, but reveals weaknesses in Latin prosody and metre. It can therefore be supposed that he should be identified as one of the many Graeco-Egyptian ‘wandering poets’, but probably not as Claudian himself. (shrink)

For non-additive set functions, the independent product, in general, is not unique and the Fubini theorem is restricted to slice-comonotonic functions. In this paper, we use the representation theorem of Gilboa and Schmeidler (Math Oper Res 20:197–212, 1995) to extend the Möbius product for non-additive set functions to non-finite spaces. We extend the uniqueness result of Ghirardato (J Econ Theory 73:261–291, 1997) for products of two belief functions and weaken the requirements on the marginals necessary to obtain the Fubini property (...) in the product. More importantly, we show that for the Möbius product one side of the Fubini theorem holds for all integrable functions if one of the marginals either is a probability or a convex combination of a chain of unanimity games, i.e., we relax the requirement of slice-comonotonicity and enrich the set of possible applications. This study aims to describe social network and social participation and to assess associations with depressive symptoms in older persons with increased risk for dementia in Germany. We conducted a cross-sectional observational study in primary care patients (aged 60-77) as part of a multicenter cluster-randomized controlled trial (AgeWell.de). We present descriptive and multivariate analyses for social networks (Lubben Social Network Scale and subscales) and social participation (item list of social activities) and analyze associations of these variables with depressive symptoms (Geriatric (...) Depression Scale). Of 1030 included patients, 17.2% were at risk for social isolation (Lubben Social Network Scale < 12). Looking at the subscales, a reduced non-family network was found almost twice as often as a reduced family network. Patients with depressive symptoms had significantly smaller social networks than patients without depression (p < 0.001). They rather engaged in social activities of low involvement level or no weekly social activity at all (p < 0.001). The study shows associations of depressive symptoms with a decreased social network and less social participation in elderly participants. Sufficient non-family contacts and weekly social activities seem to play an important role in mental health and should be encouraged in elderly primary care patients. (shrink)

Marcels Konzeption des Du zielt auf Anerkennungsverhältnisse, die der sprachlichen Interaktion vorgängig sind und grenzt sich vom idealistischen Konzept einer abstrakten transzendentalen Subjektivität ab. Die Verweigerung von Anerkennung wird von Marcel kritisiert, weil sich der Einzelne so aus dem Bereich gelebter Intersubjektivität ausschließe und unzugänglich mache.

My key argument will be that by shifting the debate over Jewish emancipation from the plane of theology, where it had been traditionally fought, to the plane of sociology, Marx was able to circumvent one of Bauer's main arguments against emancipating the Jews. Bauer had contended that as a religion of law, not of faith, Judaism was by its very nature a public creed. It was incompatible, therefore, with life in a free state, where religion could only be (...) a private matter. Marx chose to ignore this argument, treat Judaism as no different from Christianity, and focus his discussion on the nature of the state on the one hand and on the role played by the Jews in civil society on the other. This was less than a satisfactory response to Bauer's argument, but it enabled Marx to present a powerful case for emancipation while, at the same time, launching his critique of economic alienation. Thus, the philosophical advances made by Marx in On the Jewish Question were necessitated by, and integrally related to, his commitment to Jewish emancipation. (shrink)

Although the academic interest in ethical mutual fund performance has developed steadily, the evidence to date is mainly sample-specific. To tackle this critique, new research should extend to unexplored countries. Using this as a motivation, we examine the performance and risk sensitivities of Canadian ethical mutual funds vis-à-vis their conventional peers. In order to overcome the methodological deficiencies most prior papers suffered from, we use performance measurement approaches in the spirit of Carhart (1997, Journal of Finance 52(1): 57–82) and Ferson (...) and Schadt (1996, Journal of Finance 51(2): 425–461). In doing so, we investigate the aggregated performance and investment style of ethical and conventional mutual funds and allow for time variation in the funds’ systematic risk. Our␣Canadian evidence supports the conjecture that any␣performance differential between ethical mutual funds and their conventional peers is statistically insignificant. (shrink)

It has recently been pointed out that the cloudiness of the concept of authenticity as well as inflated ideologies of the ‘true self’ provide good reasons to criticize theories and ideals of authenticity. Nevertheless, there are also good reasons to defend an ethical ideal of authenticity, not least because of its critical and oppositional force, which is directed against experiences of self-abandonment and self-alienation. I will argue for an elaborated ethical ideal of authenticity: the ambitious ideal of a continuous self-reflective (...) process of ‘self-authentication’. For this purpose, the ideal of being authentic in expressing and unfolding one’s individual personality and characteristics will be combined with the ideal of being ‘an authentic person’ - whereby ‘a person’ is to be understood in a Kantian sense as an autonomous person who is reasonable and morally responsible. In the transcendental deduction, the central argument of the Critique of Pure Reason, Kant seeks to secure the objective validity of our basic categories of thought. He distinguishes objective and subjective sides of this argument. The latter side, the subjective deduction, is normally understood as an investigation of our cognitive faculties. It is identified with Kant’s account of a threefold synthesis involved in our cognition of objects of experience, and it is said to precede and ground Kant’s proof of the (...) validity of the categories in the objective deduction. I challenge this standard reading of the subjective deduction, arguing, first, that there is little textual evidence for it, and, second, that it encourages a problematic conception of how the deduction works. In its place, I present a new reading of the subjective deduction. Rather than being a broad investigation of our cognitive faculties, it should be seen as addressing a specific worry that arises in the course of the objective deduction. The latter establishes the need for a necessary connection between our capacities for thinking and being given objects, but Kant acknowledges that his readers might struggle to comprehend how these seemingly independent capacities are coordinated. Even worse, they might well believe that in asserting this necessary connection, Kant’s position amounts to an implausible subjective idealism. The subjective deduction ismeant to allay these concerns by showing that they rest on a misunderstanding of the relation between these faculties. This new reading of the subjective deduction offers a better fit with Kant’s text. It also has broader implications, for it reveals the more philosophically plausible account of our relation to the world as thinkers that Kant is defending – an account that is largely obscured by the standard reading of the subjective deduction. The pushmi-pullyu representation is a non-conjunctive representation with both descriptive and directive contents. Introduced by Millikan, the PPR is supposed to aid in explaining how organisms adapt behavior to environmental variance in the absence of intermediate inference. Until recently, it has led an uncontroversial theoretical life. However, Artiga has suggested that the PPR postulate conflicts with Millikan-style teleosemantics and, as a consequence, the PPR postulate should probably be set aside. I suggest here that the theoretical motivations for the PPR are (...) independent of any specific theory of naturalized content. If Artiga is right about the PPR’s incompatibility with Millikan-style teleosemantics, then that only reveals the inadequacy of Millikan-style teleosemantics. The PPR has a clear role to play in explaining the primitive systems that dominate the biosphere. However, Millikan did not want to limit the explanatory utility of the PPR to primitive systems but suggested that it has explanatory work to play in the animal signaling of complex organisms, Gibsonian affordances, as well as with distinctively human mental life and language. Contra Millikan, I suggest that the PPR has no or at best a very limited explanatory role to play in such cases. Further, the non-inferential feature of the PPR suggests that it should be understood at best as a marginal or borderline representation. (shrink)

Since the second half of the twentieth century, biomedical research has made increasing use of epidemiological methods to establish empirical evidence on a population level. This paper is about practices with data in epidemiological research, based on a case study in Denmark. I propose an epistemology of record linkage that invites exploration of epidemiological studies as heterogeneous assemblages. Focusing on data collecting, sampling and linkage, I examine how data organisation and processing become productive beyond the context of their collection. The (...) case study looks at how a local population database established in 1976 to investigate possibilities for the prevention of cardiovascular disease is used thirty years later to test hypotheses on the aetiology of breast cancer. For two breast cancer investigations based on the same core data set, I follow the underlying record linkage practice and describe how research objects such as molecular markers become relevant with respect to public health through information networking. Epidemiological association studies function as tools that performatively enrol different contexts into statistical risk estimation, thereby configuring options for research as well as for clinical testing and public health policy. ArgumentSince the 1970s, Danish population registries were increasingly used for research purposes, in particular in the health sciences. Linked with a large number of disease registries, these data infrastructures became laboratories for the development of both information technology and epidemiological studies. Denmark's system of population registries had been centralized in 1924 and was further automated in the 1960s, with individual identification numbers (CPR-numbers) introduced in 1968. The ubiquitous presence of CPR-numbers in administrative routines and everyday lives created a continually growing (...) data archive of the entire population. The resulting national-level database made possible unprecedented record linkage, a feature epidemiologists and biomedical scientists used as a resource for population health research. The specific assemblages that emerged with their practices of data mining were constitutive of registry-based epidemiology as a style of thought and of a distinct relationship between science, citizens, and the state that emerged as “Scandinavian.”. Statistics constitute the social universe of which they are gathered. The foundation necessary to develop quantified knowledge about society is the population. If quantified knowledge changes society, the question arises on how individuals become to be represented as population. The population has to be extracted from individuals in a process that we call “populationisation.” This encompasses the development of the individual into a segment of a population through the compilation of individual data into population data and its analysis. To describe (...) the process of populationisation, we follow a statistical risk assessment tool, the German Diabetes Risk Score, from its inception in a cohort study to its entry into the public sphere of German society. The population is extracted from individuals that function as research subjects through an identification number. Preprocessed information is entered into a dynamic database that enables its rearrangement according to main aggregates. Through populationisation, a signified is enacted that can be sliced up and that is equal in all its parts. Now predictions can be computed and fed back to society as tools of moral judgment. The acting individual and “society” are—numerically and literally!—entangled in the production and enactment of risk knowledge. (shrink)

Some critiques of cybermedicine claim that it is problematic because it fails to create physician–patient relationships. But, electronically mediated encounters do create such relationships. The issue is the nature and quality of those relationships and whether they are conducive to good patient care and meet the ethical ideals and standards of medicine. In this paper, I argue that effective communication and compassion are, in most cases, necessary for the establishment of trusting and morally appropriate physician–patient relationships. The creation of these (...) relationships requires patients and physicians to take psychological and emotional risks and to make commitments to each other. The problem is that by altering the form and content of verbal and non-verbal behaviors and by limiting the kinds of interactions that can take place, cybermedicine makes risk-free interactions easier and more commonplace and retards the development of physician compassion and patient trust. In doing so, cybermedicine encourages morally inappropriate physician–patient relationships. I argue that Merleau-Ponty''s notion of embodiment and Kierkegaard''s criticisms of disinterested reflection help us to understand how cybermedicine can undermine patient health and well being and why it should be seen as a possible threat to the moral integrity of physician–patient relationships. The dominant view in teleosemantics is that semantic functions are historically determined. That reliance on history has been subject to repeated criticism. To sidestep such criticisms, Nanay has recently offered an ahistorical alternative that swaps out historical properties for modal properties. Nanay's ahistorical modal alternative suffers, I think, serious problems of its own. I suggest here another ahistorical alternative for teleosemantics. The motivation for both the historical view and Nanay's is to provide a naturalistic basis to characterize some item as (...) possessing a function independent of its actual performance and, thereby, provide a grip on intentional inexistence and misrepresentation. I suggest that attending to the logic of mechanistic explanation suffices to provide the sought for naturalistic basis. The key advantage to the approach offered here is its relative parsimony: unlike its alternatives, it requires no substantive existential commitments, for example, commitments to natural selection, copying relations, or fitness-enhancing modal properties, to naturalize semantic content. Distributive justice deals with allocations of goods and bads within a group. Different principles and results of distributions are seen as possible ideals. Often those normative approaches are solely framed verbally, which complicates the application to different concrete distribution situations that are supposed to be evaluated in regard to justice. One possibility in order to frame this precisely and to allow for a fine-grained evaluation of justice lies in formal modelling of these ideals by metrics. Choosing a metric that is (...) supposed to map a certain ideal has to be justified. Such justification might be given by demanding specific substantiated axioms, which have to be met by a metric. This paper introduces such axioms for metrics of distributive justice shown by the example of needs-based justice. Furthermore, some exemplary metrics of needs-based justice and a three dimensional method for visualisation of non-comparative justice axioms or evaluations are presented. Therewith, a base worth discussing for the evaluation and modelling of metrics of distributive justice is given. (shrink)

Ihr gemeinsames Ziel ist die Verbesserung sozialer Interaktion durch gestalterische Intervention. Der designwissenschaftliche Gastbeitrag diskutiert verschiedene Perspektiven, in denen sich Kunst auf Design bezieht und analysiert ihre wechselseitige Differenz als kommunikative Beziehungsstruktur.

Innovation, Wachstum und Optimierung sind normative Grundlagen des Designs, der Technologie, der Wirtschaft, der Gesellschaft und der Kultur. Unter dem Vorzeichen der Digitalisierung zeichnen sich neue ›Optima‹ ab, in denen Menschen zum Bestandteil entgrenzter Netzwerkstrukturen werden. Die in Würzburg entstandenen Aufsätze des vorliegenden Bandes gehen ambivalenten Aspekten dieser Entwicklung mit wissenschaftlichen und gestalterischen Methoden nach. Der Gastbeitrag geht der Frage nach, was dialektisches Denken in Diskurs und Praxis der Gestaltung bedeutet.

Needs play a key role in many fields of social sciences and humanities, ranging from normative theories of distributive justice to conceptions of the welfare state. Over time, different conceptions of what counts as a need (i. e., what is considered a normatively relevant need) have been proposed. Many of them include (in one way or the other) needs for survival, decency, belonging, and autonomy. Little work has been done on how these kinds of needs are evaluated in terms of (...) their significance for distributive justice. To begin closing this gap, we investigate the role of the four aforementioned kinds of needs for impartial observers. We do so in two empirical studies. The first study asks participants to evaluate the importance of each of the four kinds of needs separately. We find that different levels of importance are attributed to the kinds of needs, which places them in a hierarchy. The second study asks participants to make distributive decisions. Results further support the hierarchy found in the first study and, additionally, reveal that participants tend to make coherent allocation decisions. (shrink)

Plato’s tripartite soul plays a central role in his account of justice in the Republic. It thus comes as a surprise to find him apparently abandoning this model at the end of the work, when he suggests that the soul, as immortal, must be simple. I propose a way of reconciling these claims, appealing to neglected features of the city-soul analogy and the argument for the soul’s division. The original true soul, I argue, is partitioned, but in a finer manner (...) than how we encounter it in our everyday lives. (shrink)

Los procesos educativos deben asumir de modo expreso, reflexiva y críticamente nuestros ethos originarios (histórica, filosófica y antropológicamente hablando), las condiciones de marginalidad y exclusión de la mayoría de la población mundial, y la de nuestro país dentro de la planificación del desarrollo global. This book analyzes--in terms of branching--the pervasive reorganization of Latin syntactic and morphological structures: in the development from Latin to French, a shift can be observed from the archaic, left-branching structures (which Latin inherited from Proto-Indo-European) to modern right-branching equivalents. Brigitte Bauer presents a detailed analysis of this development based on the theoretical discussion and definition of "branching" and "head." Subsequently she relates the diachronic shift to psycholinguistic evidence, arguing that the difficuly of LB complex structures as reflected in (...) their painstaking and delayed acquisition accounts for the extensive typological shift from left to right branching that took place in Latin/French and the other Indo-European languages. Einstein, Descartes, Locke, Bohr, Rorty, Berkeley, Hume, Kant -magical names When we step on an airplane, turn the key in the ignition, or switch on an air conditioner we - not just academicians - all agree that the ideas of these far-sighted sages of the Enlightenment and Modernism saved us from the Medieval life. But, as the author shows, if we fully accept their ideas a drastic change in our world-view ensues. Fred Bauer has been examining the great minds (...) for many years, and in easily understood terms gives us a surely amazing Grand Unifying Theory. Of course, he gives ample reasons why we each have to choose for ourselves - rejecting or accepting concepts. In any case, The Wonderful Myth Called Science poses an exciting and at times an emotionally challenging exploration of science and living. (shrink)

This article explores human genetic diversity research east of what was the iron curtain. It follows the technique of “genogeographic mapping” back to its early Soviet origins and up to the post-Soviet era. Bringing together the history of genogeographic mapping and genealogies of “nationality” and “race” in the USSR, I discuss how populations and belonging were enacted in late Soviet biological anthropology and human genetics. While genogeography had originally been developed within the early Soviet livestock economy, anthropologists, public health scientists, (...) and medical geneticists reanimated the technique in the late 1960s after the end of the Lysenko era and its ban on classical genetics. In the 1970s, population geneticists pursued a project to compile all genetic data on the USSR population, resulting in a “genogeographic atlas,” consisting of series of tables as well as maps projecting genetic markers onto geographic grids. Following the post-Soviet trajectories of these maps, I examine the ways in which human genetic diversity studies realign with renegotiations of difference in today’s Russian Federation. The exploration of the Soviet case of human genetic diversity research contributes to our understanding of the varied ways in which racializing discourses were entangled in the project of modernization. The formal part of this chapter is concerned with measures of need-based justice. According to the measures we propose, a distribution is unjust (i) the more it deviates from absolute need satisfaction and equal degrees of need satisfaction, (ii) the more the given undersupply could have been mitigated by transfers, or (iii) the more resources are used for oversupply instead of need satisfaction. These measures are compared, i.e., as to the satisfaction of need-oriented relatives of axioms prominent in poverty measurement; (...) and we have a critical eye on the proposals of Jasso and Miller. The empirical part reports on three vignette studies conducted to find out how people evaluate the justice of given distributions and how they distribute goods when aiming at justice. The main goal was to measure the significance ascribed to need. This significance was compared with the significance ascribed to effort or equality; and it was shown that a need’s influence decreases when the corresponding person is accountable for having a higher amount of it. In the third study, we found out that needs that are not directed at bare survival, such as the need for participation in social life, are attributed lower degrees of importance. The chapter concludes with some implications of our research for a theory of need-based justice. (shrink)

The business and human rights movement shares several goals with the Benefit Corporation movement: corporations respecting human rights; maintaining a “wide aperture” so that all impacts of a company on people and communities are addressed; and creating rigorous standards of conduct and means of accountability. This paper argues that nonetheless the movements are traveling along parallel tracks and thus missing an opportunity for mutual learning that can improve their effectiveness. The BHR movement can look to B Corps for concrete examples (...) of viable companies that value human rights intrinsically and not just where there is a “business case” to do so. The B Impact Assessment, the B Corp certification tool, can better ensure that B Corps are in fact respecting human rights by adopting BHR standards. And both movements must give greater consideration to the potential contradiction between unlimited scaling—a key goal of B Corps—and the ability of large multinational corporations to respect human rights.
